Is it legal for the apt above me in NYC to do renovations without notifiying me?

There has been constant banging, drilling, smashing, hammering...you think they would have the courtesy to tell me they are doing renovations...it's been like this for 2 weeks now! And worst yet I'm on spring break from work so I cannot sleep in as they start early at 8am.

1. They do not have to notify you, and they are well within the municipal restriction for construction. They could legally start at 6 if they so desired.
